Janan is a Barrister, specialising in English-law commercial dispute resolution for clients in the marine, energy and commodity sectors.
Since her call to the Bar in 2004, Janan has advised a broad spectrum of clients from state entities to small companies. In addition to navigating her clients through the litigation and arbitration (incl. LCIA, ICC, LMAA, GAFTA) process, she has advised on a number of commercial settlements. Janan previously worked in-house for a UK regulator and regularly advises clients on commercially driven solutions for non-contentious legal issues including the interpretation of contractual terms and drafting.
Janan has over 18 years of experience advising on shipping, energy, commodities, international trade and insurance, including significant high-value disputes. She has represented sellers, purchasers, charterers and owners on charterparty disputes, mechanical failures, ship damage, international trade, collisions and groundings, multi-million dollar Incoterm sales contracts, bills of lading, letters of credit, warranties, choice of law and arbitration clauses.
Alongside daily practise, Janan has doctoral expertise in upstream oil contracts, governance, legislation and policy and is available to advise governments and participants in the energy sector on constitutional, contractual and legislative issues.
Experience
- Acting for clients in disputes relating to recap terms, bills of lading, claims for off-hire, dead-freight, demurrage, vessel damage, stevedore liability, seaworthiness and maintenance.
- Advising on a delivery performance claim for a purchaser relating to contaminated cargo following change of vessel use.
- Advising on exclusivity clauses in relation to specific ship design issues and disputed steel prices for a shipbuilding contract
- Advising on the recovery for non-payment, breach of contract and the interpretation of a range of terms for the energy sector including offtake agreements, pipeline, FPSO, carbon capture and decommissioning.
- Acting for Reinsurer clients in a multi-billion US dollar claim relating to Russian sanctions following the invasion of Ukraine in 2022.
- Advising an energy supermajor in London Commercial Court proceedings on the interpretation of contractual and payment obligations following a counterparty's suspected fraudulent activity.
- PEC v Asia Golden Rice Co Ltd [2014] EWHC 1583 (Comm) – successfully represented clients on the authority of company agents to enter a trading contract.
